These Terms of Use (“Terms”) govern your access to and use of bookvisor.ai and the Bookvisor product (the “Service”), operated by Vista Labs Inc. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
Your data
You retain all rights to the business, financial, and conversational data you submit to the Service (“Your Data”). You grant Bookvisor a limited license to host, process, and display Your Data solely as needed to operate and improve the Service for you. You are responsible for the accuracy of the data you provide and for having the right to share any third-party data you connect.
Acceptable use
- Do not use the Service for unlawful, fraudulent, or abusive purposes.
- Do not attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service.
- Do not upload data you do not have the right to share, including data belonging to others without consent.
- Do not use the Service to build a competing product or service.
Not financial, tax, or legal advice
Bookvisor provides software tools and AI-generated insights to help you manage and understand your business. The Service is not a substitute for a licensed accountant, tax professional, attorney, or financial advisor. AI-generated answers can be incomplete or inaccurate. You are responsible for reviewing outputs before relying on them, and for consulting qualified professionals for accounting, tax, legal, or investment decisions.
Connected accounts and third parties
When you connect a bank or other financial account, you authorize us and our aggregation partner to access and use the relevant data on your behalf. Third-party services have their own terms and privacy practices, which govern your use of those services.
Text messaging (SMS)
Text messaging is optional. If you add and verify your mobile number and opt in, you consent to receive account- and service-related texts from Bookvisor — replies from your assistant and the account alerts you turn on. Bookvisor does not send marketing or promotional texts. You represent that you are the subscriber or authorized user of the number you provide.
Message frequency varies. Message and data rates may apply. Reply STOP to cancel, HELP for help. Message delivery is not guaranteed and may be delayed or blocked by carriers, network conditions, or your device or plan. Carriers are not liable for delayed or undelivered messages. Your use of text messaging is also governed by our Privacy Policy.
Intellectual property
Bookvisor, the Bookvisor name, logos, and the underlying software are owned by Bookvisor and protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the Service for your internal business purposes.
Suspension and termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if continued provision of the Service would expose us or other users to material risk. On termination, your right to use the Service ends; sections that by their nature should survive will survive.
Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation. We do not warrant that AI outputs will be accurate, complete, or free of errors.
Limitation of liability
To the maximum extent permitted by law, Bookvisor will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or related to your use of the Service. Our aggregate liability for any claim arising out of or related to the Service will not exceed the greater of (a) the amounts you paid us for the Service in the twelve months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars.
Changes to the Service or Terms
We may modify the Service or these Terms from time to time. If we make material changes to these Terms, we will notify you by email or in-product. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The exclusive venue for any dispute will be the state and federal courts located in California, and you consent to personal jurisdiction there.
